Oral Surgery San Francisco prides itself on its relationship to its patients.

best oral surgeon San Francisco

Oral Surgery San Francisco prides itself in offering a complete suite of oral surgery options in the Bay Area. The new post explains some of the key issues.

We do many wisdom teeth extractions here in our San Francisco practice,"”

— Dr. Rabinovich

SAN FRANCISCO, CALIFORNIA, UNITED STATES, September 23, 2020 /EINPresswire.com/ — Oral Surgery San Francisco, serving the Bay Area and led by Dr. Alex Rabinovich, DDS, MD, is proud to announce a new post in its series on the need for clients to do their homework when selecting an oral surgeon to remove their wisdom teeth. While wisdom teeth extraction is a very common procedure, patients are still advised to reach out for a consultation and to compare various oral surgeons in San Francisco.

"We do many wisdom teeth extractions here in our San Francisco practice," explained Dr. Rabinovich. "That volume makes us savvy on how the procedure should go, and prepared for when things are a little out of the ordinary. We strongly encourage patients to not just take a single recommendation but to reach out to us for a consultation on their wisdom teeth extraction needs."

The post can be read in its entirety at https://www.oralsurgery-sf.com/2020/08/many-people-have-wisdom-teeth-removed-you-need-a-qualified-surgeon/. It explains the pros and cons of different oral surgeons and ends with a call for the patient to set up a consultation on removing their wisdom teeth. Only a one-on-one consultation can really create a specialized plan on how best to remove one's wisdom teeth.

WISDOM TEETH REMOVAL IN SAN FRANCISCO: DO NOT DELAY

Here is the background for this release. Many patients put off wisdom teeth removal until it's urgent. They are afraid of the pain, cost, and difficulties of wisdom teeth extraction (https://www.oralsurgery-sf.com/wisdom-teeth/) and as well as of dental implants (https://www.sfdentalimplants.com/). Moreover, the current pandemic has discouraged many Bay Area residents from reaching out to oral surgeons for wisdom teeth removal. Yet one's wisdom teeth keep growing, and the time to have an oral surgeon inspect them is now. The best course of action is to reach out to a few oral surgeons for a consultation and then make a decision. As the posts argue, there is no single best oral surgeon. There is a best match for each unique patient which can be identified by doing one's homework.

Indiegogo Crowdfunding Campaign for Chicago Blues Documentary Kicks Off

This blues documentary set in Chicago is the first of its kind!”

— Connor Korte, Creator/Director of 594 Miles From Chicago

CHICAGO, IL, USA, September 22, 2020 /EINPresswire.com/ — Connor Korte, creator and director at Bluesbird Talent Agency LLC., has launched an Indiegogo crowdfunding campaign for his Chicago blues documentary project titled “594 Miles From Chicago.”

Blues is an influential musical genre that permeates jazz, rock and roll, and rhythm and blues. Its colorful origins are rooted in the Deep South, emerging as a new sound, fusing African-American work songs with traditional African musical traditions as far back as the 1870s.

The culture and art of the blues remain alive in the Chicago community. However, Korte thinks there is a need to properly document the lives of aging blues performers. He also observes there is no documentary vehicle for new blues players to tell their own stories.

Korte seeks to make a change in the current state of the Chicago blues community by interviewing and documenting the lives of older blues musicians to preserve their stories and share their memories. Likewise, Korte plans to feature the younger generation of blues players to shed light on their dreams and struggles, infusing new life and interest in the blues musical genre and community in Chicago.

Over 45 blues artists will be featured in the “594 Miles From Chicago” documentary film project, along with a highlight called “Women of the Blues” and a memorial for blues artists who have already passed.

Korte is extending his invitation to people who are willing to back this blues documentary film project, with an overall goal to raise $19,500. The amount will be used to cover expenses including camera crew services, lighting, sound, film production, licensing, fees, and promotions.

Individual backers can choose from among different donation options. There are also higher sponsorship tiers interested individuals or companies can opt for.
Korte says his planned blues documentary film project set in Chicago is the first of its kind.

Through the film, he plans to put the spotlight on the Chicago blues community and revitalize interest in the blues. Korte is also hopeful that the film would help to highlight the talented blues community and serve as a vehicle for the discovery of young talent.
Interested investors are encouraged to check out all campaign details on the “594 Miles From Chicago” crowdfunding page on Indiegogo.

Award-Winning STEM Picture Book About Animals Now Available in Spanish

Así crezco cover image

Así crezco, the Spanish edition of This Is How I Grow, will be released by Science Naturally on October 7.

Así crezco bat illustration

Stunning illustrations share the stories of eight mammal babies.

Panoramic illustrations showcase family bonding and early science education for Spanish-speaking children and dual-language classrooms.

The intricate illustrations capture and expand a child's awareness of scientific detail, from the specificities of habitats to the physical, emotional, and environmental changes animals undergo.”

— Lizabeth Paravisini-Gebert, professor of Hispanic studies, Vassar College

WASHINGTON, DISTRICT OF COLUMBIA, UNITED STATES, September 22, 2020 /EINPresswire.com/ — Science Naturally is thrilled to announce that their newest animal-themed book, This Is How I Grow, is now also available in Spanish as Así crezco.

The animal stories in Así crezco celebrate what unites all mammals, while fostering empathy, kindness, and compassion in their young readers. As the newest book in the Beginnings collection, Así crezco introduces readers to eight different animal ambassadors from habitats around the globe.

This beautiful book conveys that childhood is the period of time where mammals must rely on their family and community. In two-page vignettes, each mammal baby soliloquizes on their birth, nursing, and weaning experiences before exploring the incredible variety of skills they must learn in order to survive and thrive. From bats learning how to fly to elephants gaining control of their trunks, animal mothers and others in the community help their young develop the tools they need to hunt, forage, or scavenge. This is an engaging approach for children ages 7–10 who are just starting to explore what it means to be “all grown up.”

According to Lizabeth Paravisini-Gebert, professor of Hispanic studies at Vassar College, “The intricate illustrations capture and expand a child's awareness of scientific detail, from the specificities of habitats to the physical, emotional, and environmental changes animals undergo.” And Don Wilson, from the Smithsonian Museum of Natural History, says, “This book provides nicely illustrated and scientifically accurate, but easily absorbed stories about familiar animals."

Así crezco also helps bring valuable life science concepts into the homes and classrooms of English language learners (ELL’s). Studies show that science teachers who don't speak Spanish can still effectively teach ELLs if they provide their students with materials translated to their native language. Additionally, a 2014 case study of ELLs in science class revealed that providing translated materials can be important “as a tool towards understanding and gaining fluency in academic English.”

Author Dia L. Michels says, “We know that there's a scarcity of adequate Spanish-language STEM resources. This is an extreme disservice to Spanish-speaking students and those from mixed-language families. We hope this book will be one small step toward closing that gap.”

The original English book (This is How I Grow, March 2020) received a Book of the Year award from Creative Child Magazine, a Feathered Quill Book Award, and a Brain Child award.

The back of the book contains questions that encourage readers to delve more deeply into the visual text. These reference pages allow parents and educators to address the questions young scientists are likely to ask as they explore the pages. An extensive Teacher’s Guide, available for free download, provides further information, hands-on activities, and articulations to the Next Generation Science Standards (NGSS), making this book an invaluable science resource.

Author Dia L. Michels is an award-winning science and parenting writer who has authored or edited over a dozen books for both children and adults. This is her fourth book exploring science topics through animal stories. Studying mammals has helped her appreciate the simplicity and importance of attachment parenting and breastfeeding. The mother of three grown children, she lives in Washington D.C.

Wesley Davies is an artist from New England who specializes in illustration and comic art. He received a B.A. in anthropology from Kenyon College, earning Phi Beta Kappa honors. He provided spot drawings for Platypus Media’s 2018 publication Babies Nurse. This book marks his debut as a children’s book illustrator.

Vince Imhoff, Managing Director of Imhoff & Associates, Give DUI/DWI Traffic Stop Advice

Vincent Imhoff

Imhoff & Associates

By Vince Imhoff

LOS ANGELES, CA, UNITED STATES, September 22, 2020 /EINPresswire.com/ — I’m Vincent Imhoff and I have a nationwide criminal offense law firm that over the last 15 years, we represented thousands of people for DUI. Today, I'm going to talk to you about some of the things you can do to make sure that if police stop you, you can survive that arrest hopefully without a conviction for DUI. One of the many things you can do is politely refuse to help the police convict you. By that, I mean that you do not have to take tests; you do not have to take the breath test and you don't have to do field sobriety tests.

But what will happen is there will be an automatic suspension on your driver’s license, but you will not give the police evidence against you, which is the most important part. So, when they ask if you want to give a breath test you don't have to say yes, you can say no. If you give a breath test, your lawyer will then have to come in and determine whether or not that test was given to properly. Was the machine properly calibrated, was the operator of the machine properly trained with a proper certificate, is the certification up-to-date? Those are all things that can be done to make sure that that test is as accurate as possible. But, the best thing that could be done for that is you politely refuse that test because then there's no need for any of that other litigation and so you can survive the broadside style by not performing a breath test.

You can also survive the roadside stop by not engaging in any field sobriety tests. That means you don't let the officer judge how well you can touch your finger to your nose, or you don't let the officer judge how well you can walk in a straight line, or you refuse to stand on one foot and turn around, or any of those other gymnastics type physical test police officers give on the side of the road. If you do not engage in that they cannot then come to court and say how you did in those tests, they won't have that.

I also recommend that you do not engage in any conversation with the police. Don't tell them about your day and don't tell them you drank 2 beers that afternoon or that evening and then are just coming back from a friend’s birthday party. You say, “I'm sorry officer, I'm not going to tell you about my day”. Then at that point you just get your driver’s license, insurance card, your registration, and they go back to their car. But do not engage in conversation, everything you say to the police they will use to determine whether or not you were slurring your speech or whether you can formulate a sentence easily. Those things are objective facts that will come to court and testify about.

"Let us put our extensive experience and successful track record of defending thousands of clients to work defending you!"

If you have been accused of committing a criminal offense, it is essential that you reach out to their firm as soon as possible. The sooner you begin working with them, the sooner they can begin examining every detail surrounding your case, gathering all the evidence, and building the strongest defense possible. Because they have experienced lawyers throughout the nation, they are knowledgeable of every state’s criminal laws and know-how all of these states’ criminal proceedings are carried out.

"Individuals who turn to our firm for defense are met with respect, honesty, and diligence throughout the entirety of their case," states Imhoff & Associates. "No two cases are alike, and we ensure every client is provided with the customized defense needed to meet their unique needs. We believe in doing everything we can to put our client's minds at ease, which is why we also implement one-time, flat-fees. This means you do not have to worry about how long you are on the phone with us or how many times you meet with us; you will never be charged any hidden expenses." With Imhoff & Associates, it looks like no matter what your case entails, you will work with the right attorney for your case; someone who is from your area, is well-versed in that particular area of law, and knows how to customize the best possible defense for your specific case.

Thousands of Australian public sector workers protected as government agencies adopt CriticalArc’s SafeZone technology

SafeZone app

The SafeZone App is part of the overall SafeZone solution.

Latest wave of adoptions driven by framework agreement enabling rapid procurement

Thanks to the framework agreement we have in place, public agencies can move ahead with rapid procurement. We look forward to working with many of Australia’s public agencies in the coming months.”

— Glenn Farrant, CEO & Co-founder, CriticalArc

SYDNEY, SUTHERLAND NSW, AUSTRALIA, September 23, 2020 /EINPresswire.com/ — Thousands more public sector employees in Australia are to benefit from 24/7 safety support, enhanced lone-worker protection and organisation-wide emergency response following the adoption of SafeZone® by key government agencies.

The service, from CriticalArc, has been adopted by the Australian Tax Office (ATO), Sydney Trains, the Australian Bureau of Statistics, Crown Victoria, the Australian Nuclear Science and Technology Organisation (ANSTO) and – in the first use of the technology by an Australian public healthcare provider – St Vincent’s Hospital, Sydney.

This new wave of adoptions, with multi-year contracts, comes after the successful deployment of SafeZone by Sydney Trains and New South Wales Transport. The procurement framework agreement originally put in place as a result of the ATO contract, now allows more rapid, easy adoption by other public agencies, both locally and nationally.

SafeZone is already widely used in the higher education sector, in Australia and globally, and has become the most popular single-platform solution to enable organisations to manage all personal safety, security and emergency situations more quickly, effectively and proactively to better protect their employees. It enables individual users to call for assistance and receive rapid response at the touch of a button, and provides the tools for their organisation to manage an optimal response to any situation.

Geo-fencing allows users to be protected by SafeZone even when they are working remotely. It allows individuals to request emergency help or general support and ensures that their location can be immediately pinpointed by first responders. When used with integrated indoor positioning functionality it allows users to be located to within three metres, even in multi-floor buildings.

The service makes it easy for organisations to manage a wide range of situations, mitigating risks to staff and customers and strengthening the capacity to respond to incidents and emergencies. For example, at

Sydney Trains the technology puts up to 2,500 front-line staff directly in touch with security control room teams, and now covers more than 175 urban and suburban stations.

Mark Edmonds, Sydney Trains’ Manager of Security Capability, Network Operations says this is protecting employees on crowded city platforms at rush-hour and those working alone at night in remote suburban stations.

“Sydney Trains is committed to fulfilling our duty of care to all of our staff and enhancing our high safety standards in order to maintain and enrich customer service levels on station platforms. Employing proven technology such as SafeZone will help us solve day-to-day challenges, further improving the safety of our staff and helping them work more effectively to continue to deliver world-class service.”

Glenn Farrant, CEO, CriticalArc, welcomed the latest adoptions across Australia’s public services as significant step forward for improved employee safety and duty of care.

“It’s great to see the technology’s benefits being recognised by visionary teams in many sectors.” he said. “Thanks to the framework agreement that we now have in place, public agencies can also move ahead with rapid procurement. We look forward to working with many more of Australia’s public agencies in the coming months.”

He added that SafeZone has also played an important role helping organisations adapt to the challenges of COVID-19. Thanks to its ability to be deployed rapidly – in recent cases in as little as one week – it is enabling users to ramp-up preparations for safe returns to work, and helping with the re-opening of sites in compliance with stringent new requirements.

SafeZone has proved itself to be a high value service that’s highly adaptive and is giving organisations a tangible boost to employee safety and wellbeing.

Level 3 Construction Completes 52-Unit Mixed Use Development in Downtown Oceanside, CA

SALT project in downtown Oceanside, CA

SALT – Oceanside, CA

It was so great to be a part of this project and help revitalize the downtown beach community”

— Ian Mahon, President and CEO of Level 3 Construction

VISTA, CALIFORNIA, USA, September 22, 2020 /EINPresswire.com/ — Level 3 Construction, a leader in hospitality renovation and construction, proudly announces the completion of “SALT,” another state-of-the-art project: A five-story mixed use development with 52 residential units including 8,508 sqf. of ground floor retail space developed by Pelican Communities in the heart of Oceanside.

Construction has completed on SALT, one of the several ground-up development projects in progress that are reshaping the skyline of Oceanside. This 52-unit mixed use, mid-rise development will bring new ground floor retail space to the heart of downtown Oceanside with four additional stories of residential living space. Level 3 Construction was awarded the second half of this two-phased project which kicked off in early 2018.

The project began as a public/private partnership with Pelican Communities and the City of Oceanside to build 335 public parking spaces and a mixed-use project on a surface parking lot in the downtown. The parking structure (Phase I) was completed in December of 2017 under a separate public contract with a specialized contactor. Level 3 Construction involvement in the project began with early preliminary budgeting and preconstruction services for the retail and residential component of the development (Phase II). The second phase officially kicked off in January of 2018.

Level 3 Construction’s early dedication to their client and the project helped cement their role in the project and establish the relationship with the developer and Construction Management firm. Level 3’s extensive hospitality experience also played a key role in the final design specifications and finish package of the residential units. Their ability to self-perform a number of different trades with their small army of multiskilled tradesmen was also leveraged to provide competitive pricing and an aggressive schedule.

“It was so great to be a part of this project and help revitalize the downtown beach community,” said Level 3’s President and CEO, Ian Mahon.

The completed project will activate the entire block and enhance the community with the exciting new retail tenants that have begun to occupy the space along with the convenient parking just blocks from the Oceanside Pier. TGTE Appeal to UN to Help Thileepan’s Memorial to be Observed Peacefully in Sri Lanka

United Nations

" Thilleepan died after a protest hunger strike against Sri Lankan Government sponsored Sinhalese settlements (Colonization) in Tamil areas "

NEW YORK, UNITED STATES OF AMERICA, September 22, 2020 /EINPresswire.com/ —

Transnational Government of Tamil Eelam (TGTE) today sent an urgent appeal to the United Nations Special Rapporteur on Freedom of Peaceful Assembly & Association and the United Nations Special Rapporteur on Freedom of Opinion and Expression, urging them to help Thileepan’s memorial to be observed peacefully in Sri Lanka.

This appeal was sent after several Magistrates, at the request of the Police, banned remembrance of Martyr Thilleepan, who died after a protest hunger strike against Sri Lankan Government sponsored Sinhalese settlements (Colonization) in Tamil areas.

Two days ago Tamil political parties jointly urged Sri Lankan President to lift the ban on remembering Martyr Thileepan. In that letter they said that “The prohibition has caused severe pain of mind and emotional impact on the collective consciousness of our people”

The appeal to the UN was submitted by Global Diligence LLP – International law and human rights compliance – on behalf of Transnational Government of Tamil Eelam (TGTE).

The appeal urges UN Special Rapporteur to:

• Send an URGENT Communication to the Sri Lankan Government, urging it to ensure that all Sri Lankan public authorities respect the Tamil’s right to pay homage to Lt Col Thileepan, through peaceful assembly and expression, at this years’ events. In particular, that:

• The current prohibition on the 2020 Annual Commemoration to pay homage to Lt Col Thileepan and related celebrations, is immediately lifted;

• All Sri Lankan public authorities respect the Tamil’s right to peaceful assembly with respect to the 2020 Annual Commemoration, without any further unwarranted interference.

BELOW, PLEASE FIND THE FULL REQUEST:

URGENT REQUEST

Violations of the Rights to Peaceful Assembly and Association and to Freedom of Opinion and Expression in Sri Lanka

RE: Prohibition of the 33rd Commemoration of Lt Col Thileepan’s Passing

22 September 2020

1. This request is submitted jointly to the United Nations Special Rapporteur on Freedom of Peaceful Assembly and Association and the United Nations Special Rapporteur on Freedom of Opinion and Expression. It is submitted by Global Diligence LLP,1 on behalf of the Transitional Government of Tamil Eelam (“TGTE”).
2. The recent prohibition by Sri Lanka authorities of the 33rd Commemoration of Lt Col Thileepan’s hunger strike to death is a matter of serious frustration for Sri Lanka’s beleaguered Tamil People. If not addressed, it has the potential to heighten ethnic tensions in this highly volatile environment. Intervention by the UN Special Rapporteurs is both justified and urgent. The events were planned for this week, with the main event being 26 September 2020.

I. The Facts:

3. The Tamil People in Sri Lanka have been engaged in decades of struggle – both armed and peaceful – for liberation from the oppression meted out by the Sinhalese majority government in Columbo, Sri Lanka.3 On 13 September 1987, the Liberation of Tamil Eelan (“LTTE”) leadership handed a letter to India with five demands (the LTTE believed the Indians could force the Sri Lanka’s to comply). On 15 September 1987, when no response was received from India, the LTTE’s political leader in Jaffna Peninsula – Lt Col Thileepan – went on a hunger strike hoping to persuade India to meet its five demands.4 The 23-year-old Lt Col Thileepan gave speeches that were broadcast widely, and many participated in his hunger strike. On 26 September, after refusing water for 12 days, Lt Col Thileepan died. He was given a martyr’s funeral in Jaffna.
4. Since his death, Annual Commemorations have been held to pay homage to Lt Col Thileepan (“Annual Commemoration”). However, this year, the Annual Commemoration and the week-long celebrations leading up to it have been banned, by two Magistrate Courts. Acting at the request of the Police, the Magistrate Courts of Jaffna and Mullaitivu issued orders banning the commemorative events.5 According to the (unofficial) translation provided to Global Diligence, the Jaffna Court justified its decision thus:

The Chief Police Inspector of the Jaffna Police Station has submitted a Report in the above-mentioned case stating that the LTTE has been designated as a banned organization under Government Gazette No. 1721/2 dated 2011.08.29 of the Democratic Socialist Republic of Sri Lanka, that the following persons have made arrangements for inviting people to come to the Memorial Pillar of one Rasaiya Parthiban @ Thileepan, a prominent member of the above-said banned organization, situated opposite the Rio Ice Cream Parlour, Nallur within the jurisdiction of Jaffna Municipal Corporation, that preparations have been made to celebrate his memory by holding meetings, street-side marches and vehicle rallies with the participation of some persons having come over from foreign countries without due permission and that there is a grave risk of the Covid-19 pandemic spreading through them and so has prayed of this Hon’ble Court to ban the memorial event.

Hence, in exercise of the powers bestowed on me by Section 106 of the Criminal Procedure Code I pass this order to ban the holding of the above-said memorial event, gathering the public for meetings and rallies within the jurisdiction of this Magistrate Court in this regard.

The Magistrate Court of Mullaitivu reasoned that:

The Chief Police Inspector of Mullaitivu has reported that the above-mentioned persons have, by way of remembering Rasaiya Parthiban @Thileepan a member of the banned organization (LTTE), applied for organizing a Fast Opening Day Rally, Public Meeting and other events in the police jurisdiction of Mullaitivu during the period from 18.09.2020 to 26.09.2020, which is a punishable offence under section 79(2) read with 79(3) of the Police Act, and under the Isolation and Prevention of Diseases Act, Act No. 3 of 1891. Furthermore, it is a punishable offence under the Special Gazette No. 1721/2 issued on 2011.08.29 with regard to eradication of terrorism. Hence the above-mentioned persons are hereby banned from organizing any fasts, memorial meetings or functions with regard to the organization banned by the Government in the period from 18.09.2020 to 26.09.2020 and I pass this order in exercise of my powers bestowed upon me by Section !06 (1)(3) of the Criminal Procedure Code, Act No. 15 of 1979.

5. As is apparent from the above, the two Magistrates banned the assemblies on the basis that:
a. Lt. Col. Thileepan was a member of the LTTE at the time of his death –which was declared an illegal organization several years later.
b. Police had allegedly received information that unnamed foreign citizens were planning to attend the event, which risked spreading COVID19.

6. In the run up to the Annual Commemoration, at least one former Tamil Member of Parliament has reportedly been arrested. On 15 September, M. K.
Shivajilingam, a former northern provincial council member, was arrested as he attempted pay tribute to Thileepan in Nallur.6 Furthermore, security forces have reportedly destroyed certain arrangements made for the Annual Commemoration.7

7. On 19 September 2020, representatives from Tamil political parties based in the North and Eastern Provinces, sent an urgent appeal to Sri Lankan President Gotabaya Rajapakse.8 The appeal highlighted the “political and emotional significance” for the Tamil people in “paying their Homage to Martyr Thileepan”, and stated that the prohibition has caused “severe pain of mind and severe emotional impact on the collective consciousness” of the Tamil people. The Tamil representatives asked the Sri Lankan President to intervene and noted that if the ban was maintained they would have no alternative but to register their “disapproval and condemnation in a peaceful and democratic manner.”

II. The Law:

1. Peaceful Assembly:

8. The right of peaceful assembly is a fundamental right protected by the Article 21 of the International Covenant on Civil and Political Rights (“ICCPR”) and is provided for in other international and regional instruments.9 In its recent General Comment of 17 September 2020, the Human Rights Committee (“HRC”) stressed that:

“The fundamental human right of peaceful assembly enables individuals to express themselves collectively and to participate in shaping their societies. The right of peaceful assembly is important in its own right, as it protects the ability of people to exercise individual autonomy in solidarity with others. Together with other related rights, it also constitutes the very foundation of a system of participatory governance based on democracy, human rights, the rule of law and pluralism. […] Where they are used to air grievances, peaceful assemblies may create opportunities for the inclusive, participatory and peaceful resolution of differences. […] (Para 1)

It is of particular importance to marginalized individuals and groups. Failure to respect and ensure the right of peaceful assembly is typically a marker of repression.”10 (Para 2)

9. Importantly, the HRC noted that the right to peaceful assembly is not negated simply because the subject matter is contentious. And assemblies that may cause disruption must still be protected and managed by the State:
“However, peaceful assemblies can sometimes be used to pursue contentious ideas or goals. Their scale or nature can cause disruption, for example of vehicular or pedestrian movement or economic activity.11 These consequences, whether intended or unintended, do not call into question the protection such assemblies enjoy. To the extent that an event may create such disruptions or risks, these must be managed within the framework of the Covenant.” (Para 7)

10. The law is clear. States have an international legal obligation to “respect and ensure” (ICCPR Article 2.1) peaceful assemblies can take place “without unwarranted interference and to facilitate the exercise of the right and to protect the participants.” Accordingly, “States are obliged not to prohibit, restrict, block, disperse or disrupt peaceful assemblies without compelling justification, nor to sanction participants or organizers without legitimate cause” (HRC Comment para 23). Importantly, States must ensure that the courts do not interpret laws in a discriminatory manner:
“States must ensure that laws and their interpretation and application do not result in discrimination in the enjoyment of the right of peaceful assembly, for example on the basis of race, colour, ethnicity […]. States have a duty to protect participants from all forms of discriminatory abuse and attacks.” (HRC Comment para 25).

11. Whilst States may impose restrictions under Article 21, these restrictions “must be narrowly drawn” (HRC Comment para 8). The grounds for restriction, as laid out in the last part of the second sentence of Article 21, provide an exhaustive list, consisting of: the interests of national security; public safety; public order; the protection of public health; or morals; or the protection of the rights and freedoms of others. Restrictions cannot be based on “the identity of the participants or their relationship with the authorities” (HRC Comment para 22). Such restrictions must be (i) prescribed by law, (ii) taken in pursuit of legitimate aims (e.g. prevention of crime), and (iii) must be necessary and proportionate to those aims.12

2. Freedom of Opinion:

12. The full protection of the right of peaceful assembly is possible only when other overlapping rights are also protected, notably freedom of expression and opinion.

III. The Analysis:

13. According to the UN Human Rights Committee, establishing whether someone’s participation in an assembly is protected by Article 21 entails a two-stage process:13 First, it must be established whether or not the conduct falls within the scope of the protection offered by the right, in that it amounts to ‘peaceful assembly’.14 Second, it must be established whether or not any restrictions applied to the exercise of the right are legitimate in that context.

For such restrictions to meet the requirement of legality, they must be both necessary and proportionate to at least one of the grounds for restriction enumerated in Article 21, whilst being guided by the objective of facilitating rather than limiting that right.

14. The Magistrates’ order banning the Annual Commemorations to pay homage to Lt Col Thileepan violates the Tamil’s right to peaceful assembly and to freedom of expression. First, neither the Police nor the Courts provided any evidence suggesting that the Annual Commemoration would not be peaceful. Second, the outright ban on all related events is not ‘legitimate in the context’ and is not ‘necessary and proportionate’ to any of the grounds for restriction enumerated in Article 21.

15. The Police applied for, and the Court granted the ban on two bases. First, that Tamils should not be permitted the celebrate a former leader of the LTTE, a banned organisation. This is misplaced. Placing an organization (rightly or wrongly) on a terrorist list, cannot serve as a justification to prohibit communities paying respects to the dead, unless the acts of commemoration fall within Article 21. Respect for the war dead, and their graves, is protected under human rights law, in particular the right to human dignity and respect for private life.

16. The second justification was that unnamed foreign citizens were planning to attend the event and hence there was a risk of spreading COVID19. With respect to the risk of spreading COVID-19, the Magistrates provided no evidential basis for their decisions; and failed to identify a single “foreigner” who was planning to attend the event. Nor did the Magistrates explore other ways to facilitate the Commemorations in a time of pandemic, such as social distancing or mask wearing. Therefore, COVID19 cannot serve as a justification to ban outright the commemorative events on the basis of public health. Indeed, the misuse of the COVID19 pandemic to restrict basic rights is well-documented. According to the UN Special Rapporteur on Counterterrorism and Human Rights, these types of arbitrary actions around the globe could lead to “a parallel epidemic of authoritarian and repressive measures following close if not on the heels of a health epidemic.”

17. The only reasonable interpretation of the facts is that the Magistrates’ decisions to ban the Annual Commemoration was rooted in racial or ethnic oppression and discrimination, namely, discrimination against Tamils. In other words, the Courts’ prohibition is based on “the identity of the participants [and] their relationship with the authorities.” This misuse of powers by the Police and Magistrates amounts to a “discriminatory abuse and attack.” Since Sri Lanka “must ensure that laws and their interpretation and application do not result in discrimination in the enjoyment of the right of peaceful assembly, for example on the basis of race, colour, ethnicity […]”, Sri Lanka is in clear violation of its duty to “respect and ensure” the rights to peaceful assembly and freedom of expression with respect to the Annual Commemoration to pay homage to Lt Col Thileepan.

IV. Request:

18. On behalf of the TGTE, we respectfully request that you send an URGENT Communication to the Sri Lankan Government, urging it to ensure that all Sri Lankan public authorities respect the Tamil’s right to pay homage to Lt Col Thileepan, through peaceful assembly and expression, at this years’ events. In particular, that:

• The current prohibition on the 2020 Annual Commemoration to pay homage to Lt Col Thileepan and related celebrations, is immediately lifted;

• All Sri Lankan public authorities respect the Tamil’s right to peaceful assembly with respect to the 2020 Annual Commemoration, without any further unwarranted interference.
